Terms & Conditions
Please read these Terms and Conditions carefully, as they will govern your navigation of Andy Kocher Sport Horse Auctions. Those who bid are bound by these Terms and Conditions, which serves as the contract of sale between the successful bidder (“buyer”), and the consignor (“seller” or “Andy Kocher Sport Horse Auctions”). When bidding on any item offered by Andy Kocher Sport Horse Auctions, the buyer indicates acceptance of the following Terms and Conditions. Any participation in the auction binds you to agreement of these Terms and Conditions, whether or not you read or understand said Terms and Conditions. If you do not wish to be bound by these Terms and Conditions, you may not use the Andy Kocher Sport Horse Auctions website or auction services. All items sold are subject to the following Terms and Conditions.
Buyer and Seller agree to these Terms and Conditions and affirm under penalties of perjury that all information furnished is true and correct. Buyer and Seller represent and agree that he/she is of legal age and is competent to form a binding contract.
Getting Started
In order to bid on lots from Andy Kocher Sport Horse Auctions, one must register at Auction.AndyKocher.com/Account/Register. Or show up in person at Jim Brandon Equestrian Center in West Palm Beach, FL and obtain a bidder number and paddle. You may also bid by telephone ( call Andy at 205-523-3088, Kelly 864-497-296, Mike 201-889-7280, or Stella 908-797-9776) and by absentee bidding ( fill out a form ).
Each bidder must create a separate account, which includes registering credit card information. Credit cards will not be charged unless a winning bid is secured (Please see: Payment for more information).
Before or During the Auction
A buyer has an option to examine the item.
Bidding
Bidding is conducted online, live, over telephone, or by leaving and absentee bid.
Bid Closings are staggered, closing by minutes apart. Lots close at the times stated for each entry.
Seller Confirmation
Every Lot is subject to seller confirmation after the final bid has been made.
Buyers Premium
There will be a 5% buyers premium added to each item sold.
Payment
Full payment may be submitted via one of the following methods at the choice of the buyer: cash, credit card, wire/bank transfer, etc. Seller will contact the buyer to arrange full payment.
Full payment must be received within three (3) business days from the close of the auction. The item must also be picked up within this time frame. Additional terms, if requested, can be negotiated with Seller.
Within three (3) business days of receiving full payment, the buyer will receive a bill of sale for the item as well as a title if one has been listed as available in the description.
Transportation costs and arrangements are the responsibility of the Buyer.
By placing a bid in this auction, the buyer agrees: 1) to be responsible for any purchase made or actions taken by an Agent authorized by Buyer to act on Buyer’s behalf; 2) that registration to bid is not assignable without the express written approval of Andy Kocher Sport Horse Auctions; 3) that if the Buyer has the winning, final bid, or the accepted bid in the auction subject to Andy Kocher Sport Horse Auctions’ confirmation, the buyer has entered into a binding contract to purchase the item.
There is no warranty expressed or implied by Andy Kocher Sport Horse Auctions as to the performing soundness, merchantability or fitness for any particular purpose of any item offered in this sale, other than those made specifically by Andy Kocher Sport Horse Auctions.
All items are sold “as is” with all existing conditions and defects.
Andy Kocher Sport Horse Auctions will not release an item to a buyer until the buyer has made full payment for the item and funds have been verified. If a sale is rejected; if full payment is not submitted by specified deadline; or if the item is not picked up by the specified deadline; the item remains the property of the Seller. The Seller would then have the right to re-sell the item.
The buyer assumes all risk, responsibility and expense for the item at the end of bidding or, if sold pending confirmation by Andy Kocher Sport Horse Auctions, upon confirmation of selling price by the Seller. Seller will provide up to three (3) business days (or otherwise agreed upon timeline between buyer and Seller) of basic storage and care until full payment is received and the item is picked up.
This is a Reserve Auction.
The right of the Seller to bid on his/her own item is expressly reserved.
Refusal of Service
Andy Kocher Sport Horse Auctions reserves the right to reject any bid or refuse to issue a bidding number to anyone for any reason.
Tie Bids
If an online bid and live bid are the last bids and made at the same time the live bid will take precedence
